Agreement to the Terms and Conditions and the Privacy Policy
Terms and Conditions
CHAPTER I GENERAL PROVISIONS Article 1 (Purpose) These Terms and Conditions aim to prescribe the user conditions and procedures, the rights of the support center and users thereof, duties and responsibilities, and any other necessary matters for all services (hereinafter referred to as the “service”) provided on the website of the Global Biomedical Innovation Human Network Center (hereinafter referred to as the “Support Center”). Article 2 (Effect and Modification of Terms and Conditions) (1) These terms and conditions will come into effect by notifying thereof through online services of the Support Center and other methods. (2) The Support Center may modify these Terms and Conditions without prior notice if an important cause arises, and the modified Terms and Conditions will be effective by announcing thereof in the same way as provided in paragraph (1). (3) If a member does not agree to the modified Terms and Conditions, he/she may request to cancel his/her membership. If he/she continues to use the service after the effective date of the modified Terms and Conditions, the member will be deemed to have agreed thereto. Article 3 (Rules Outside the Terms of Service) Matters not specified in these Terms and Conditions will be governed by the Framework Act on Telecommunications, the Telecommunications Business Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, Etc. and other applicable statutes. Article 4 (Definitions) The key terms used in these Terms and Conditions are defined as follows: 1. General member: The term refers to a person who has signed a service user agreement with the Support Center and has been given a user ID. Full member: The term refers to a person who has signed a service user agreement with the Support Center, has been given a user ID, and has entered training information for the Biomedical Global Talent Nurturing Program. Non-member: This term refers to a person who uses the service without joining the membership. 2. Administrator: This term refers to a person selected by the Support Center for the overall management and smooth operation of the service. CHAPTER II CONCLUSION OF A SERVICE USER AGREEMENT Article 5 (User Agreement Formation) (1) If a user selects "I agree" at the time of subscription, he/she will be deemed to have agreed to these Terms and Conditions. The same will apply for any modified Terms and Conditions, and if a user does not agree to the modified Terms and Conditions, he/she may cancel his/her membership registration at any time. (2) The service user agreement becomes effective by the Support Center's approval of the service application after a person who wishes to use the service agrees to the Terms and Conditions. Article 6 (User Application) Those who wish to join the membership and use the service must provide the details required by the Support Center in the prescribed application form. Article 7 (Approval of User Application) (1) The Support Center will approve the user application under Article 6 in the order of receipt, unless under extenuating circumstances. (2) In any of the following circumstances, the Support Center may restrict the approval of the user application, and may postpone the acceptance until the cause thereof is resolved: 1. Where the service-related facilities lack the capacity; 2. Under any technical difficulties; 3. Where it is deemed necessary due to other circumstances of the Support Center. (3) If the Support Center becomes aware of any of the following matters, it may not approve the user application: 1. Where a user has not filed an application under his/her real name; 2. Where an application is filed using another person's name; 3. Where a user application is filed by falsely stating required entries; 4. Where an application is filed for the purpose of hindering the well-being and order of society or the good customs of society; 5. Where other requirements for user application set by the Support Center are not fulfilled. (4) If the approval of the user application is postponed or not approved pursuant to paragraph (2) or (3), the Support Center must notify the applicant thereof; Provided, That exceptions will be made where it is not possible to notify the applicant without any reasons attributable to the Support Center. Article 8 (Protection of Personal Information) (1) The Support Center will protect and respect members' personal information. (2) The Support Center makes its utmost efforts to ensure that the members' personal information provided to the Support Center online is protected. Therefore, the Support Center endeavors to protect the members' personal information, including member’s registered information, as prescribed by pertinent statutes that service providers must comply with, such as the Protection of Communications Secrets Act, the Telecommunications Business Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, Etc. For the protection and use of member's personal information, the applicable statutes and the Privacy Policy of this website will be applicable. (3) The Support Center collects information on members through information provided by each member at the time of user application, community activities, the information provided by each member to participate in various events, and other information collected during the service use. The personal information of members is used only for the purpose of fulfilling the performance under this User Agreement and providing services under this User Agreement. (4) The Support Center is barred from divulging or distributing any personal information of members acquired in connection with the service provision to a third party without the consent thereof, or from using personal information for commercial purposes. However, this will not be the case in any of the following circumstances: 1. Where necessary for the settlement of charges due to the provision of information and communications services; 2. Where a particular individual is processed and provided in an unidentifiable form, as necessary for preparing statistics, academic research, or market research; 3. Where a request is made by an associated agency in accordance with the procedures and methods set out for investigative purposes under applicable statutes; 4. Where special provisions are provided under other statutes; 5. Where a request is made by the Korea Communications Standards Commission. (5) The Support Center may send cookies to a member's computer through the service. The member may change his/her browser settings to deny the receipt of cookies or to issue warnings about the receipt thereof. Article 9 (Modification) (1) A member may access and modify his/her personal information at any time through personal information management. (2) Where any modification has been made since user application, the member must make online modification and the member will be responsible for any issue arising from the failure to change his/her information. CHAPTER III RIGHTS AND DUTIES OF THE SUPPORT CENTER AND ITS MEMBERS 제 10 조 (지원센터의 의무) Article 10 (Duties of the Support Center) (1) The Support Center is under the duty to provide the service in a continuous and reliable manner, except under any of the following circumstances: 1. Where it is inevitable due to repair, periodic inspection, or construction of service facilities; 2. Where a facilities-based telecommunications business operator suspends telecommunications services prescribed under the Telecommunications Business Act; 3. Where a wartime, war, natural disaster, or equivalent national emergency has occurred or is feared to occur; 4. Where the service use is hindered due to a facility failure or a surge in use, etc.; (2) The Support Center employs appropriate procedures for any comments suggested by the member according to the prescribed procedures and informs the member of the reason and processing schedule if the processing takes a certain period of time. Article 11 (Duties of Members) (1) A member must comply with the applicable statutes, the provisions of these Terms and Conditions, the instructions for use, the precautions announced in the service, and the matters notified by the Support Center, and must not interfere with the business of the Support Center. (2) A member must not engage in any profit-making activities using the service without the prior consent of the Support Center, nor may he distribute or publish any data in violation of the statutes. (3) A member is responsible for maintaining and managing his/her ID and password and is fully responsible for all consequences arising from his/her use of ID and password. In addition, if a member’s ID and password are used without his/her consent, he/she must notify the Support Center immediately, and the member will remain fully responsible for his/her failure to issue a notice. (4) A member must not engage in any of the following acts in connection with the service: 1. Duplicating, reproducing, modifying, translating, publishing, broadcasting, or otherwise providing information obtained using the service to others without the prior consent of the Support Center; 2. Harming social order by means such as publishing obscene materials or establishing links to or distributing obscene websites 3. Defaming or insulting others or infringing on the rights of others such as intellectual property rights, etc.; 4. Continuously transmitting certain contents, such as hacking or distributing computer viruses or advertising information against the will of others; 5. Fraudulent use of the ID of another member; 6. Collecting and storing other users' personal information; 7. Impersonating another person, including employees, managers, etc. of the Support Center; 8. Forging the sender of any content transmitted through the service; 9. Stalking or bullying others; 10. Engaging in any act that interferes with or is likely to interfere with the operation of the service, or in violation of other applicable statutes; Article 12 (Exemption Clause) (1) The Support Center does not guarantee the accuracy, reliability, etc. of any information, data, or facts posted or transmitted by members through the service and does not assume responsibility for any damage sustained by the member's selection or use of the data in the service. (2) The Support Center does not assume responsibility for any gain or loss expected by using the service or any loss caused by the data obtained through the service. (3) This Support Center has no obligation to intervene in disputes arising between members or between a member and a third party with the service as a medium nor is it responsible to compensate for any resultant damage. (4) The Support Center will be exempt from liability for any failure caused by reasons attributable to the member in his/her service use. (5) Where a member breaches any provision under these Terms and Conditions and causes damage to the Support Center, the breaching member must compensate for all damages sustained by the Support Center and must indemnify, defend, and hold harmless the Support Center from and against such damages. Article 13 (Compensation for Damages) The Support Center will not be held liable for any loss caused to the members in connection with the service provided by the Support Center, except in the event of gross negligence of the Support Center. Article 14 (No Transfer) A member must not transfer or assign the right to use the service or other contractual status for use thereof to other persons and must not provide such rights as collateral. CHAPTER IV SERVICE USE Article 15 (Scope of Service Use) A member may use the service provided on the website of the Support Center with a single ID issued at the time of his/her subscription to the Support Center: Provided, That as for the content provided by an affiliate separately, this may not be the case. Article 16 (Provision of Information) The Support Center may provide members with various information deemed necessary during their service use, by means such as announcements or e-mail. Article 17 (Fees for Content Use) (1) The service provided by the Support Center is free of charge by default: Provided, That for paid services and paid information, a member must pay the fee specified in the information to use it. (2) For any paid information services in the future, the scope and price list will be notified separately. ARTICLE 18 (Member's Posts) The Support Center may delete the content within the service posted or registered by the member without prior notice if it is deemed to fall under any of the following: 1. If the content slanders or defames another member or a third party with a false statement; 2. If the content is contrary to the public order and good custom; 3. If the content is deemed associated with a criminal act; 4. If the content infringes upon the copyright of the Support Center or a third party, or any other rights; 5. If the posting period or capacity specified by the Support Center is exceeded; 6. If obscene materials are posted or obscene websites are linked; 7. If the content encourages illegal copying or hacking; 8. If the content is an advertisement for profit; 9. If the content that does not conform to the nature of the bulletin board is posted; 10. If it is deemed to be in violation of other applicable statutes. Article 19 (Copyright of Posts) The rights to the data posted on the service are as follows: 1. The publisher will hold the rights and responsibilities in relation to his/her posts, and the Support Center is barred from using them for any purpose other than publication in the service without the consent of the publisher: Provided, That this is not the case in non-profit cases, for which the Support Center will hold the right to publish them in the service. 2. A member is barred from using the data posted in the service for commercial purposes by means such as processing and selling information obtained during his/her service use. Article 20 (Service Hours) (1) The Support Center starts to provide the service immediately after approving the member's user application: Provided, That if the Support Center is unable to provide the service due to a business or technical failure, it will make an announcement in the service or notify each member thereof. (2) The service is used 24 hours a day all year round by default: Provided, That all or part of the service may be temporarily suspended due to business or technical reasons of the Support Center, or during the period determined by the Support Center for operational purposes. In such cases, the Support Center will notify its members in advance or thereafter. (3) The Support Center may separately determine the available hours for each service, and in such cases, it will make an announcement of the details in advance. Article 21 (Suspension of Service Provision) As for the free service, all or part of the service may be modified or discontinued at any time due to the need of the Support Center, and in such cases, the Support Center will notify the members immediately via e-mail or the Internet website. CHAPTER V TERMINATION OF AGREEMENT AND RESTRICTIONS ON SERVICE USE Article 22 (Membership Cancellation and Restrictions on Use) (1) If a member intends to terminate the User Agreement, he/she must request the membership cancellation using the member information management on the website of the Support Center. (2) If a member commits any of the following acts, the Support Center may terminate the User Agreement without prior notice or block the member from using the service for a set period of time: 1. If he/she commits an act contrary to public order and good customs; 2. If he/she engages in an act associated with criminal conduct; 3. If he/she plans the service use for the purpose of hindering national or social interests or executes such plans; 4. If he/she steals another person's ID and password; 5. If the name provided at the time of his/her subscription is not his/her real name; 6. If he/she damages the reputation of others or disadvantages others; 7. The same user is registered for multiple accounts with different IDs; 8. If he/she commits an act that hinders the healthy use, such as causing harms to the service; 9. If he/she spreads a computer virus program, etc. that causes malfunction of information and communication facilities or destruction of information, etc.; 10. If he/she commits any act in violation of other applicable statutes or conditions of use set out by the Support Center; Addendum 1. (Effective date) These Terms and Conditions will enter into force on October 1, 2020.

Consent to the collection and use of personal information

The Support Center collects the following minimum required personal information at the time of initial membership registration for member subscription, smooth consultation for members, and provision of a wide variety of services. B. During the service use, the following information may be automatically generated and collected. - IP address, cookies, access dates, service use records, and defective use records [Right to refuse consent and disadvantages] If a member refuses to consent, he/she will not be able to subscribe to the Support Center, and his/her access to certain posts that are available only to the members of the Support Center may be restricted. A member has the right to refuse consent to the above collection and use of personal information. However, if a member does not agree to the required information, he/she will be restricted from using the service (member subscription).
